3.5. We also welcome ideas for new features or improvements.
4. How we will contact you
4.1. We will usually contact you by email, using the address linked to your account, or through notifications sent by the App.

6. Updates to these Terms
6.1. We may update these Terms from time to time without asking for your specific agreement. Where a change is significant, we will let you know by email. If you hold a paid subscription, changes take effect from the end of your current subscription period (normally your next payment date).
6.2. If you are unhappy with a change, tell us and we will close your account as described in section 20.
6.3. If you keep using Muslim Hearts after a change, you are accepting the updated Terms.

7.1. To use Muslim Hearts you must:
7.1.1. be at least 18 years old, which you confirm by giving your date of birth when you sign up;
7.1.2. not have been banned from Muslim Hearts by us, or be prevented from using it by the laws that apply to you;

7.2. Muslim Hearts is for your own personal, non-commercial use only.

7.4. Your device must meet our minimum technical requirements and those of the Apple App Store or Google Play Store.
7.5. You are responsible for arranging your own access to Muslim Hearts, such as your device and internet connection.
8. Your Account
8.1. You can sign up using your email address or a third-party login such as Facebook, Google or Apple. If you use a third-party login, we will receive certain details from that provider, such as your name, email address and date of birth. Our Privacy Policy explains this further.
8.2. If you sign up by email, you must be the only owner and user of that email address and of the mobile number you give us, and you must verify the number.
8.3. If you sign up or verify through a third-party account, that provider must have confirmed you are 18 or over, you must be the only person who uses that account, and the information you gave when opening it must be true and complete.
8.4. The information you give us must be accurate and up to date, and you must keep it that way. If it is not, we may suspend or close your Account.
8.5. You are responsible for everything done through your Account. Keep your login details private and tell us straight away at info@muslimhearts.co.uk if you think someone else has used your Account or it is no longer secure.
8.6. You may only create an Account for yourself, in your own name.
9. Purchases and subscriptions
9.1. Some features of Muslim Hearts are paid for (each a “Paid Feature”) and bought inside the App (an “In-App Purchase”). These may be one-off purchases, such as a profile boost, or subscriptions, such as a premium membership.
9.2. Ordering. To buy a Paid Feature, tap the purchase button. Extra terms may be shown to you when you buy, and these form part of these Terms.
9.3. Prices. Prices are shown in the App and include VAT or any equivalent tax. We may change prices at any time, but this will not affect orders already placed unless the price shown was a mistake.
9.4. Payment. You can pay through Stripe, Apple Pay, Google Pay, the Apple App Store, the Google Play Store or any other method we offer (a “Payment Method”). Card payments must be approved by your card provider. We take payment when you place your order.
9.5. Automatic renewal. Subscriptions renew automatically. You choose a subscription length of one week, one month, three months, six months or one year (a “Subscription Period”). You pay the advertised price when your subscription starts, and it then renews for the same Subscription Period, with payment taken on or around each renewal date.
9.6. By subscribing, you allow us to take repeat payments using your Payment Method until you cancel or we end your subscription under these Terms. We will notify you around the renewal date, including the renewal price and whether it has gone up. You may opt out of the renewed Subscription Period up to 14 days after the renewal date to avoid being charged for it.
9.7. Cancelling. You can cancel a subscription or order at any time. For subscriptions, cancellation takes effect at the end of the Subscription Period you have already paid for, and that payment is not refunded. See section 10.3 for how to cancel. Deleting the App, deleting your Account or having your access suspended may not cancel your subscription automatically.
10. Your cooling-off rights
10.1. If you live in the UK or EU, you can change your mind and cancel a Paid Feature order (or your membership) within 14 days of receiving your order confirmation or account welcome email, except as set out below.
10.2. You cannot cancel:
10.2.1. digital content (such as boosts or similar one-off features) once you have started using it, provided you agreed when ordering that you would lose this right; or
10.2.2. a service (such as a subscription) once it has been fully provided.
10.3. To cancel, use your account or cancel through the Google Play Store or Apple App Store, either directly or through the App.
10.4. You must pay for any part of a service you received before cancelling. We do not refund the time you used a premium membership before telling us you changed your mind.
11. Content you share
11.1. Members can share material on Muslim Hearts such as text, photos, videos, audio, links and messages (“User Content”).
11.2. User Content you share is “Your Content”. It must follow these Terms, including the Community Rules, and you alone are responsible for it.
11.3. You keep ownership of Your Content. You give us a free, non-exclusive, never- ending licence to use, copy, adapt, share and display Your Content on and in connection with Muslim Hearts, and to pass these rights to third parties such as our service providers and other members.
11.4. This includes the right to exercise all copyright and publicity rights in Your Content, worldwide, for as long as those rights last.
11.5. You confirm you have all the rights needed to give us this licence.
11.6. We do not endorse, and are not responsible for, User Content, and we have no duty to check, edit or remove it (section 12 explains how we moderate). Other members’ views are their own, not ours.
11.7. You can remove Your Content by deleting it.
11.8. Chaperone. You may choose a trusted person (a “Chaperone”) to oversee your conversations. Turn this on in the Chaperone settings in the App and enter your Chaperone’s email address. We will email them instructions, and once they complete these, they will receive a weekly or live copy of your written conversations. You can switch this off at any time in the same settings.

12.5. We do not have to monitor Muslim Hearts or review Content, but we may monitor, moderate, edit, block or remove any User Content we believe breaks these Terms. We use a mix of automated tools and human review to find content that breaks our rules. We may also work with law enforcement to help prosecute members who break the law.
12.6. We only review User Content when it relates to something we are looking into, for example a question or report from a member, content flagged by our moderation process, an appeal against a suspension, or a technical problem. You agree we may access and use Your Content for these purposes.
13. Reporting content

We may also change Muslim Hearts and its Paid Features for other reasons, for example to reach more people, improve or add services, meet technical or operational needs, or remove features that are not popular. There will be no extra cost to you. We will tell you by email or in-app message, reasonably in advance, what is changing and when, and remind you of your right to close your Account under section 20.

18.3. We may also close your Account for legitimate business reasons by giving you notice by email.
19. Temporary suspension of service
19.1. We may temporarily suspend Muslim Hearts or a Paid Feature to:
19.1.1. fix technical problems or make small technical changes;
19.1.2. update it to reflect changes in law or regulation; or
19.1.3. make changes to Muslim Hearts or its Paid Features (see section 16).
19.2. We will tell you in advance unless the problem is urgent or an emergency.

24. Our responsibility to you
24.1. We take reasonable care to make sure Muslim Hearts works to a satisfactory standard, but some features depend on networks and connections outside our control. We are not responsible for any failure or delay caused by events beyond our reasonable control.
24.2. We do not promise that Muslim Hearts will work with every device or piece of software, or that it will always be available.
24.3. We are not responsible for any loss or damage that:
24.3.1. was not reasonably foreseeable (meaning it was not obvious it would happen and nothing you told us beforehand suggested it might);
24.3.2. results from you not following these Terms;
24.3.3. is a business loss;
24.3.4. results from you not installing an update within a reasonable time, where we gave clear instructions and explained the consequences of not installing it; or
24.3.5. you could have avoided by taking reasonable steps.
24.4. Our total liability to you is limited to the greater of (i) the amount you paid us in the 12 months before your claim, or (ii) £100. Nothing in these Terms limits our liability where the law does not allow it, including for death or personal injury caused by our negligence or that of our staff, agents or subcontractors, or for fraud or fraudulent misrepresentation.
24.5. We are not a party to any arrangement made between members through Muslim Hearts.
24.6. We are not responsible for how any member behaves. We do not check what members say about themselves, and we do not carry out criminal background checks or other background enquiries. Age, selfie and identity checks are carried out on a best- efforts basis and we cannot guarantee they are accurate.

26. Linking to Muslim Hearts
26.1. You may link to Muslim Hearts as long as you do so fairly and legally and without harming or taking advantage of our reputation. You must not suggest that we are associated with, approve of or endorse you or anything else unless we do.
26.2. You must not frame Muslim Hearts on any other website or link to any page other than the login page.
26.3. For any other use of our Content, please email info@muslimhearts.co.uk.
26.4. We may withdraw permission to link at any time without notice.
27. Links and adverts on Muslim Hearts
27.1. Muslim Hearts may link to third-party websites and services. You visit them at your own risk. These links are provided for convenience only, and we are not responsible for their content, products or services.
27.2. Your use of any other website or service is governed by that provider’s own terms and policies, which you should read first.
27.3. Muslim Hearts may show adverts and promotions from third parties (such as Google AdMob). Any dealings you have with advertisers are between you and them only, and we are not responsible for any loss or damage arising from them or from their adverts appearing on Muslim Hearts.
28. Viruses
28.1. We take reasonable steps to keep Muslim Hearts free from viruses and other harmful software, but we cannot guarantee it. We are not liable for any loss or damage caused by a virus, denial-of-service attack or other harmful material affecting your device.
29. Legal matters
29.1. Each section of these Terms stands on its own. If a court or authority decides any part is unlawful, the rest remains in full effect.
29.2. These Terms are personal to you. You may only transfer your rights or obligations to someone else with our written agreement.
29.3. We may transfer our rights and obligations under these Terms to another organisation. We will tell you in writing if we do, and your rights will not be affected.
29.4. If we delay in enforcing these Terms, we can still enforce them later.
29.5. These Terms are between you and us. Nobody else may enforce them.
29.6. These Terms are governed by the law of [England and Wales].
29.7. The courts of [England and Wales] have exclusive jurisdiction over any dispute about these Terms. However, if you live in Northern Ireland, Scotland or the European Union, you may also bring proceedings in the courts where you live.
Additional US Terms
If you live in the United States, these Additional US Terms apply on top of the Terms of Use above, and in some places replace parts of them as stated. If the two conflict, these Additional US Terms take priority. References to the Terms of Use below mean the Terms of Use as changed by these Additional US Terms.
Arbitration agreement (replaces section 29.7)
Please read this arbitration agreement carefully. It requires you to resolve certain disputes with MUSLIM HEARTS LIMITED (“Muslim Hearts”) through arbitration and limits how you can seek relief. You and Muslim Hearts agree that, for any dispute about these Terms, Muslim Hearts’ officers, directors, employees and independent contractors (“Personnel”) are third-party beneficiaries of these Terms and may enforce them against you.
(a) Rules and scope. Both sides will first try in good faith to settle any dispute about these Terms by negotiation, and must do so before starting arbitration. If that fails, the dispute will be finally decided by binding arbitration in [US CITY / STATE], in English, under the JAMS Streamlined Arbitration Rules and Procedures in force at the time (the “Rules”), by a single commercial arbitrator with substantial experience in intellectual property and commercial contract disputes, chosen from the JAMS list under the Rules. Any court with jurisdiction may enter judgment on the award.
(b) Costs. The Rules govern arbitration fees. Muslim Hearts will pay all arbitration fees for claims under $75,000, and will not seek its legal fees and costs unless the arbitrator finds your claim frivolous.
(c) Small claims and intellectual property. Either side may bring an eligible claim in small claims court in [US CITY / STATE] or in the US county where you live or work. Either side may also ask any competent court at any time for an injunction or other equitable relief to stop actual or threatened infringement or misuse of its copyrights, trade marks, trade secrets, patents or other intellectual property.
(d) No jury trial. YOU AND MUSLIM HEARTS GIVE UP ANY CONSTITUTIONAL AND STATUTORY RIGHT TO GO TO COURT AND HAVE A TRIAL BEFORE A JUDGE OR JURY, AND CHOOSE ARBITRATION INSTEAD. Arbitration is usually more limited, quicker and cheaper than court, and courts can review it only in very limited ways. In any court case about confirming or overturning an arbitration award, YOU AND MUSLIM HEARTS GIVE UP ANY RIGHT TO A JURY and agree the case will be decided by a judge.
(e) No class actions. ALL CLAIMS COVERED BY THIS ARBITRATION AGREEMENT MUST BE BROUGHT INDIVIDUALLY, NOT AS PART OF A CLASS. CLAIMS OF DIFFERENT USERS CANNOT BE COMBINED OR HEARD TOGETHER. If this waiver is found invalid or unenforceable, neither side may require arbitration, and all disputes will go to court as set out in (g).
(f) Opting out. You can opt out of this arbitration agreement by writing to us at [POSTAL ADDRESS], postmarked within 30 days of first accepting these Terms. Your notice must include (i) your name and home address, (ii) the email address and/or phone number linked to your Account, and (iii) a clear statement that you are opting out of this arbitration agreement.
(g) Where cases are heard. If you opt out under (f), or this agreement otherwise allows a dispute to go to court, this arbitration agreement will not apply, and any court case (other than small claims) will be brought in the state or federal courts located in [US CITY / STATE].
(h) Severability. If the ban on class actions and other representative claims is found unenforceable, this whole arbitration agreement will be void. This arbitration agreement continues after your relationship with Muslim Hearts ends.
Limitation of liability (replaces section 24.4)
TO THE FULLEST EXTENT THE LAW ALLOWS, NEITHER MUSLIM HEARTS NOR ITS LICENSORS, SUPPLIERS, PARTNERS, PARENT, SUBSIDIARY OR AFFILIATED COMPANIES, NOR ANY OF THEIR OFFICERS, DIRECTORS, MEMBERS, EMPLOYEES, CONSULTANTS, CONTRACTORS, REPRESENTATIVES, AGENTS, SUCCESSORS OR ASSIGNS (TOGETHER, THE “MUSLIM HEARTS PARTIES”) WILL BE LIABLE TO YOU OR ANYONE ELSE, UNDER ANY LEGAL THEORY (INCLUDING CONTRACT, TORT OR STRICT LIABILITY), FOR: (A) ANY INDIRECT, SPECIAL, INCIDENTAL, PUNITIVE OR CONSEQUENTIAL DAMAGES, INCLUDING LOST PROFITS, BUSINESS INTERRUPTION, LOST DATA, LOST GOODWILL, WORK STOPPAGE, ACCURACY OF RESULTS, OR COMPUTER FAILURE OR MALFUNCTION; (B) THE COST OF SUBSTITUTE GOODS, SERVICES OR TECHNOLOGY; (C) ANY AMOUNT, IN TOTAL, ABOVE [$100 OR YOUR CHOSEN AMOUNT]; OR (D) ANY MATTER BEYOND OUR REASONABLE CONTROL. SOME STATES DO NOT ALLOW CERTAIN DAMAGES TO BE EXCLUDED OR LIMITED, SO SOME OF THESE LIMITS MAY NOT APPLY TO YOU.
Indemnity
You agree to protect and compensate the Muslim Hearts Parties against all claims, liabilities, damages (actual and consequential), losses and expenses (including legal fees) arising from (a) your use of the service, including anything done by someone else using your Account, and (b) your breach of these Terms.
Governing law (replaces section 29.6)
These Terms are governed by the Federal Arbitration Act, applicable federal law and the laws of [US STATE], without regard to conflict-of-laws rules.
